Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and ListingForge (“ListingForge”, “we”, “us”). If you are using ListingForge on behalf of an agency, you confirm that you are authorised to bind that agency to these Terms, and “you” includes that agency. If you do not agree, do not use the service.

2. The service

ListingForge is a software platform that helps estate agencies generate property marketing material — including descriptions, portal and social copy, brochures and lead-capturing landing pages — from details and photos you provide. We may add, change or remove features over time to improve the service.

3. Eligibility and your account

• You must be at least 18 years old and operating as, or on behalf of, a property practitioner or agency that is lawfully entitled to market property in South Africa.
• You are responsible for keeping your login details secure and for all activity that happens under your account.
• You must provide accurate information and keep it up to date. Tell us promptly of any unauthorised use of your account.

4. Subscriptions, billing and cancellation

• ListingForge is offered on subscription plans billed in South African Rand. The features and limits of each plan are described on our Pricing page.
• Paid plans renew automatically at the end of each billing period until cancelled. Payments are processed by Paystack.
• You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you will retain access until then. Fees already paid are non-refundable except where required by law.
• We may change our prices on reasonable notice. Changes apply from your next billing period.
• If a payment fails or your account exceeds a plan limit, we may suspend generation or downgrade features until the matter is resolved.

5. Acceptable use

You agree not to:

• Use the service for any unlawful, fraudulent or misleading purpose.
• Upload content you do not have the right to use, including photographs or descriptions that infringe someone else’s intellectual property or privacy.
• Market property you are not lawfully authorised to market.
• Attempt to disrupt, reverse-engineer, scrape, or gain unauthorised access to the service or its underlying systems.
• Resell or white-label the service except where your plan expressly permits it.

6. AI-generated content — your responsibility

ListingForge uses artificial intelligence to draft marketing copy. This content is generated automatically and may contain errors, omissions or inaccurate statements about a property. It is a drafting aid, not a substitute for your professional judgement.

You are solely responsible for reviewing, editing and verifying every listing before you publish or distribute it. You must ensure that the final material is accurate, not misleading, and compliant with all applicable laws and professional obligations — including the Property Practitioners Act, 2019, the rules of the Property Practitioners Regulatory Authority (PPRA), the Consumer Protection Act, and any portal or platform requirements. We are not responsible for content you choose to publish.

7. Your content and data

You retain ownership of the property details, photographs and other content you upload, and of the leads captured through your landing pages. You grant us a limited licence to host, process and display that content as needed to provide the service (including sending property details to our AI provider to generate copy, as described in our Privacy Policy).

You are responsible for ensuring you have the rights and any necessary consents for the content and personal information you upload, and for handling the leads you receive in line with POPIA.

8. Intellectual property

The ListingForge platform, including its software, design, branding and templates, is owned by us and protected by law. These Terms do not transfer any of our intellectual property to you. Marketing copy generated for your listings is yours to use for your property marketing.

9. Third-party services

The service relies on third parties (such as Supabase, Vercel, Anthropic, Paystack and Resend) and may reference or integrate with property portals. We are not responsible for third-party services, and your use of them may be subject to their own terms. We are not affiliated with or endorsed by any property portal unless expressly stated.

10. Disclaimers

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties that the service will be uninterrupted, error-free, or that generated content will be accurate, complete or fit for a particular purpose. You use the service at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, ListingForge will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, losses or costs arising from your use of the service, the content you publish, or your breach of these Terms or of any law.

13. Suspension and termination

You may stop using the service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the service in a way that risks harm to others or to the platform. On termination, your right to use the service ends; provisions that by their nature should survive (such as intellectual property, disclaimers, liability and indemnity) will continue.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of ListingForge after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa, and you submit to the jurisdiction of the South African courts in respect of any dispute, without affecting any rights you may have under consumer-protection law.
